Internet Life Begins at 35

The Internet. It started 35 years ago this month of September. So if you're thirty-five years old, you're as old as the Internet. And of course, being the Internet -we are bound to have some controversy. In this case, it's about the date of birth. Most people believe it to be September 2, 1969, when two computers at the University of California, Los Angeles were linked in a lab via a 15-foot cable and sent test data back and forth. Some, however, view the birth date as January 1, 1983, when 400 or so computers on the ARPANET (the Advanced Research Projects Agency Network*) switched to a new protocol called TCP/IP. A few years after 1969 came e-mail. Next, in the late 70's, was the development of TCP/IP, the core communications methodology used today, followed in the 80's by the domain name system where it was no longer necessary to type that dotted decimal notation. For example, instead of typing http://217.160.248.180, you could type http://www.photosource.com. Then came the Web. We all know what the Web hath wrought. And of course, the Internet is ever-inspiring new aspects (think SPAM and security). Here are some items in the pipeline and/or being tested:

NEW DEVELOPMENTS

New security protocols are being looked at and developed. A next-generation numbering system called IPv6, to expand the number of available IP addresses (unique numbers without which you couldn't get anywhere on the Internet). A "parallel" Internet network dubbed Internet2, available to selected universities, institutions, and companies, that offers up to 100 times the speed of typical broadband. Internet telephoning (discussed in the prior PhotoResearcher Newsletter). And some companies are laying fiber optic cable right into homes instead of using the fiber just for trunk lines. Even NASA is in on this, working on a way to extend the Internet into space for improved communications with spacecraft and satellites. Of course, here come the naysayers, companies that value profit over public good and government agencies that want to censor (or monitor or tax or spy on) information flow.

Archival vs. Poly Pages

```````````````````````````````````

Should photographers use archival or poly pages for storing their transparencies?

This question might at first seem a moot point, now that 'digital' has arrived. But please be aware that many photobuyers, especially at graphic houses and ad agencies, still require slides rather than digital images.

I have not figured out whether the question of 'archival' sleeves for slide storage is myth, hype, or reality. At my seminars, people tell me of their problems with polyvinylchloride (the cheaper, sturdy, sleeves). However, those particular complaints are from people who live in places like New Orleans, Washington DC, and San Francisco -- probably the most humid places in the nation.

One reality: the archival sleeves don't 'hold' slides in the sleeves well. Example: An art director holds an archival slide page up to the light; something slips out unnoticed onto the floor, the art director steps on it and says, "What's this under my foot?" There's not much archival quality to a slide that's been stepped on.

My recommendation for this controversy:

Store slides in filing cabinets in 'archival' pages, and send slides to a photobuyer in the thick, strong, 'poly' pages. -Rohn Engh

Court Untangles Bureaucratic Catch-22

Many of us have at one time or another faced the nightmare of bureaucratic rules which seemingly have no possible resolution.

A recent New York County Supreme Court decision untied such a knot with appropriate references to Joseph Heller's Catch-22 and Lewis Carroll's Alice's Adventures in Wonderland. Although the case did not involve photography matters, the issues are universal.

In 1988, the petitioner obtained a marriage license from the City Clerk and was married to husband number one. They had two children whose births were duly certified, recorded and filed with the City Department of Health. In 1995, husband number one died in an accident. His death was also duly certified and recorded with the applicable authorities.

In 1998, the petitioner obtained the requisite marriage license from the City Clerk and married husband number two. The marriage certificate was duly recorded as required. Unfortunately a divorce followed which was (of course) duly filed on April 14, 2004.

Petitioner met and wanted to marry husband number three. As stated in the decision, "she took the familiar trip to the City Clerk's Office to obtain a marriage license." Instead, she was informed she was ineligible (!) for another marriage license because, according to the City Clerk's records, she was concurrently married to two other men!

Picture Rights

"If a photographer 'sells' a picture to a client, do they lose their 'rights' to that picture?"

The Copyright Law of 1976 (enacted into law on Jan. 1st 1978) places special emphasis on this question. A photo belongs to the photographer, from the moment they snap the shutter. The law protects the creator of the "work" (in this case, a photograph) by making the assumption that unless it is otherwise stated in writing, the ownership of the work rests with the creator of the work, not the buyer of the "license" to use it. In other words, if a photographer is on assignment to take specific pictures for a client, and no written statement is made regarding ownership (not just "use" rights) of the resulting pictures -- the photographer owns them. In the old days (pre-1976) it was assumed that the client who purchased the license to use the photo, owned the picture. Now it's considered that when a client "purchases" a picture for use, they are only "renting" the picture for that use. Ownership (copyright) stays with the photographer.

WORK FOR HIRE

Some clients will be aware of this stipulation and will include on their contract form or agreement letter, this phrase: "Work For Hire." If a photographer signs such an agreement or contract, they do relinquish their rights to the picture(s).

Here are definitions of "rights" that are commonly accepted in the industry:

One-time rights -- the client or publication has permission to use the picture only once. Most stock photos are 'rented' or 'leased' on a one-time-use basis.

First Rights -- the same as one-time rights, except that the client or publication pays a little more for the opportunity to be the first to publish the picture(s).

Exclusive rights -- the client or publication has exclusive reproduction rights of the photograph for a specified amount of time. Example: one or two years for a post card, or three years for a brochure. After that time the photograph rights return to the photographer.

"If It Can Fail..."

In a recent article in PhotoAimLite, freelance travel photographer and PSN columnist Jeremy Hoare related how "the Nixvue Vista 30GB portable hard drive I bought failed spectacularly, losing the 250 pictures I'd already downloaded and erased from the CF cards." There's an important message here, namely this: "If it's a technological tool it can fail, and if it has moving parts it will fail." The only question is when, not if. No solution is completely safe, but redundancy comes close.

Like Hoare, we also opted for the Nixvue portable hard drive for storing our images while traveling. But we bought two of them. "That's understandable, there are two of you." No, that's not it. We bought the larger capacity 40GB version, and we each back up all of our shots to both units. If one fails, we've got the other.

Similarly we have two 160GB hard disks in our primary computer. After uploading new images or completing a Photoshop session, the top-level images folder is copied to the second hard disk. If one fails, we've got the other. Once a week we back up our images to yes, you guessed it, two DVDs-from two different manufacturers. One we store near-at-hand in our home office, the other in a safe-deposit box at our bank. There are no 100 percent guarantees, but with redundant backups you can come pretty close. And the next time technological tool termination attacks, just call out the reserves. - David Arnold\Gail Rutman.

 

 

 

FORGIVING AND FORGETTING

My experience as an attorney who provides advice on taxes for people in the stock photography industry, is that folks frequently learn the expensive way that the IRS slaps stiff penalties on tardy taxpayers who miss the deadlines for filing returns or making payments. To get the feds to waive a penalty, you have to convince them that the delay was "due to reasonable cause and not due to willful neglect."

The tax enforcers have long-standing guidelines on what this means. Though the agency tells its examiners to judge each case by its own facts, there are certain circumstances that will generally excuse a late filing or payment.

EXCUSES, EXCUSES. So what cause is reasonable? Here are some IRS examples of generally acceptable excuses:

Records not available: For reasons beyond the taxpayer's control, records necessary to compute the tax were not obtainable.

Late delivery: While the taxpayer mailed the return or payment in time to reach the IRS by the deadline, through no fault of the taxpayer, it was delivered late.
