When Are
Model Releases Required?
Advance Notes : There’s been no area of editorial stock photography more misunderstood than the topic of model releases. Here’s some clarification.
Photo columnists, unaware of their First Amendment Rights , have been fanning the fires of this hotly debated question for decades. A wall of mythology has built up around the subject, and I'll make the first move to break it down for you. To give a simplistic answer: No, for editorial usage a model release is not needed.
Have you ever seen a newspaper photographer ask for a model release? Did the video photographer in the Rodney King case ask the policemen or Mr. King for a model release ?
If a photo is informing or educating the public, you do not need a model release.
And this is where the confusion comes in. Here at PhotoSource International we focus on the editorial arena and follow the trail of the new generation of new media. Its emphasis is the publication trade: magazines, books, and electronic media. About a million dollars a day are spent in this category of stock photography, whose essential mission is to INFORM and to EDUCATE . Photographic use in this arena rarely requires a model release, unless the photo is so sensitive that it might compromise a person in some way. Short of highly sensitive areas such as drug abuse, sex education, mental retardation, you won't find requests for a model release.

Most small business owners scramble to keep ahead. As the saying goes, they are too busy making a living to take the time to make a life. "Where are you headed...?" I've asked small business people over the years. Most of them point to a mythical room, somewhere over there. If they survive, they believe they will gain entry to that room, where they'll find peace, an abundant life, time to travel, even a trout stream. They consider hard work and long hours to be the passwords or keys to that mythical room they'll gain entry to once they have "paid their dues." For those of us engaged in aspects of the stock photo industry, this need not be the case. We have the opportunity to be our own boss, work at our own time schedule, and live where we want to, right from the start. I know many entrepreneurs who said early in their career, "Here's where I want to live; here's what I want my lifestyle to be." They pulled up stakes and went for it. They are fulfilling their expectations, and most people define this as success. You can turn that mythical room and all its treasures into reality when you break away from the stereotype and settle in to a thriving lifestyle, one that will allow your talents to blossom. Your spirit will blossom, also. Your friends and family will see you as a new person. Many of the barriers that you anticipated will fall -- thanks to your persistence , and much of the overhead that you may have thought was necessary in life (designer clothing, a current-year car, a status address) will become unessential. Your new lifestyle will force you to discover creative survival techniques. It will be a struggle, yes, but aren’t some of your best memories those where you overcame an uphill struggle or challenge ?
