Pending Copyright Act Amendments

Advance Notes: Two bills which would amend the Copyright Act , including an enhancement to the available civil penalties for copyright infringement, and creation of new enforcement offices with significant funding, have recently been introduced in Congress. The Senate version, Bill S. 2317, entitled Intellectual Property Enforcement Act of 2007, was introduced on November 7, 2007. The House of Representatives version, Bill H.R. 4279, formally known as the “Priority Resources and Organization for Intellectual Property Act of 2007" but referred to as the “PRO  IP” Act for short, was introduced on December 5, 2007.

Although both bills have bipartisan support and seek to strengthen and harmonize the protection of intellectual property, including copyrights and trademarks , it is likely that they will be significantly modified as they make their way through the legislation process.

Copyright Registration Certificate
 
Both proposed bills would provide that a Certificate of Copyright Registration will satisfy the requirements needed for copyright infringement litigation, “regardless of any inaccurate information contained in the certificate,” unless it was willfully known to be inaccurate and the Register of Copyrights would have refused registration if the inaccurate information was known. If inaccuracies are alleged during a lawsuit, the court would be required to obtain the advice of the Register on whether the Register would have denied registration if the inaccuracies were known.
 
This would eliminate the technical defense in copyright infringement litigation that the Certificate of Registration was inaccurate, unless the inaccuracy was material.
 
Statutory Damages
 
A copyright owner would be entitled to receive statutory damages for each copyrighted work that is found to be infringed, and to obtain either one or multiple awards with respect to infringement of works that are lawfully included in a compilation or a derivative work and any pre-existing works upon which it is based. The court would be able to consider any relevant facts including whether the infringed works are distinct works having independent economic value.
 
As a result, the maximum amount of statutory damages for infringement of a compilation would increase from a single amount of $30,000 (or $150,000, if willful) to the possibility of multiple awards of that amount. This, if enacted, would be a major change, since existing law limits recovery of statutory damages to one award for a compilation (such as a magazine spread) even if there are multiple images in the compilation.

Volunteering

I do pro bono work for organizations working with issues that are near and dear to me. Most recently I have been working with updating the photography for the Children’s Advocacy Center in Lincoln, Nebraska.

In this Sidebar, I would like to challenge you to find something in your local area that you can volunteer your expertise and services for.

Volunteering is a genuine win-win activity. Besides being a good thing to do, it will get your name out there in your local community. People involved in volunteering on the local level are often worth getting to know. It might lead to work for you, too, since business owners and community leaders often are involved in local organizations. Even if it doesn’t lead directly to buyer contracts, getting your name out there to the local community and business leaders is a good thing, and can really help you as your photography research business grows.

THEY NEED YOU

Photography is something almost all organizations need. Finding photos for communications with local donors, photos for a new brochure or fundraiser are just a few examples where your expertise can make a big difference for a local non-profit.

Costs associated with volunteering are most often deductible on your taxes. Only actual costs, though. Keep a log of miles driven, plus any expenses, and discuss this with your accountant come tax-time.

Volunteering can be rather addictive. Once you start it can be difficult to stop, not that you should stop. It is OK to set limits for your volunteering. A limit is actually a good idea – it prevents you from burnout from doing too much of the good stuff.

You have a unique skill-set to offer local organizations. Volunteering your services doesn’t have to cost you more than your time and a little depreciation on your equipment.

It is well worth it. Trust me on this.

Step 1: Using the popular search engine, Google, type in the words or phrase that describes the picture you need.

Step 3: The source (or sources) of the photo you need will appear on your screen. You can be sure you will be dealing with a qualified photographer. Click on his or her name. When their page comes up, scroll down the page of text until you see your request highlighted in red.

Step 4: Phone, fax, or e-mail the photographer and request a digital sample (or lightbox) to view the image choices. You deal directly with the photographer for payment for the use of the photo. No middleman fees.

HOAXES AND VIRUSES. Computer viruses are like colds. You usually don't know where they come from and you don't know (usually) if you're passing one on to others. Most computer viruses arrive in attachments. If you receive an email with an attached file from an unknown source, it's simply best to delete it. That “c” with a circle around it, ©, is the familiar copyright notice. On a photo, it alerts readers, and would-be infringers, that the photo is under U.S. Copyright Law protection.

Does this symbol need to be displayed on all your photos for you to be protected? In other words, if someone uses a photo without the permission of the photographer, but the photo does not contain a copyright notice, is that person still guilty of infringing?

he answer is yes. Someone who uses a photo they see in a publication, without getting the photographer’s permission (let alone paying him or her), is violating copyright, whether or not there’s a copyright notice on the photo. Under current law, photos are protected by copyright whether or not the photographer puts a copyright notice on them. However, the fact that a photo does not have a copyright notice on it may result in a lower damages award, under copyright law’s "innocent infringer" defense.
